The point is:- how would you have played a double from partner over your LHO's 3spade? Responsive style? The problem is overcome if partner's double over 3spade is played as penalties, which is exactly what partner wanted to do, but could not because an agreement was for it to be responsive! If North passes that imposes a hefty responsibility on you to reopen with those South cards over West's 3spade - again, not ideal. With the current fashion of raising in West's position with little more than 13 cards and a smile, maybe to play a penalty double in North's position is not so daft. Discuss this one with partner.

What happened at the table? All I know is that North did not pass 3spade - he likes playing the cards and bid 3NT, made on a mis-defence.
